当下的司法与媒体的关系被认为是纯民主的当代幻想。人们对司法制度的指责已经发生了从其功能紊乱到不称其职的微妙转变,最终媒体粉墨登场开始代替制度的自我监督作用。尽管受其本身所处位置所限,但是媒体由于其特殊属性充分证明其能作为司法的替代品更好地发挥应有的作用。正因其能更好地呈现民意,促进公民之间的交流,媒体已然成为了纯民主的竞技场。自此,法院除了进行调解和讨论时,已脱离了感性和理性的框架而成为公开场所。简而言之,我们正在见证媒体,这个可以游离民主本位的幻想的真正含义。或许像“我们可以预见什么样的东西能完善我们的制度,或者什么样的东西会破坏我们的制度”这样的问题依然会被提起,但是我们会不会冒险重走原始之路呢?
The current relationship between the judiciary and the media is considered a purely democratic contemporary fantasy. People’s accusations of the judicial system have undergone a subtle shift from their dysfunction to their ineffectiveness. Eventually, the media began to replace the system of self-supervision. Despite its own place, the media, due to its special nature, is amply demonstrated that it can play its due role as a judicial substitute. Just because it can better present public opinions and promote exchanges among citizens, the media has become a purely democratic arena. Since then, apart from the framework of sensibility and reason, the court has become an open place in mediation and discussion. In short, we are witnessing the media, the real meaning of this illusion of free democracy. Perhaps questions like “We can anticipate what kind of things will improve our system or what will destroy our system will still be raised, but will we risk taking the original path again?”
