虽然国内近年出台了几部旨在取消民间资本进入石油上游产业链壁垒的法规文件,但现有垄断格局未出现明显改观。本文在现有体制下,结合现行法律法规、政策,并比较分析国外石油行业资本和行业控制权力分布状况,从投资、产权及交易成本的角度进行探讨,对中国石油行业引入竞争,打破垄断格局,完善法律保障体制,促进中国石油产业健康发展。
Although several domestic regulatory decrees have been issued in recent years to eliminate the barrier of private capital from entering the upstream oil industry chain, the existing monopoly has not changed significantly. Under the current system, combining the current laws, regulations and policies, and comparatively analyzing the distribution of capital and industry control power in foreign oil industry, this paper discusses from the aspects of investment, property rights and transaction costs, introduces competition to Chinese oil industry and breaks the monopoly , Improve the legal guarantee system and promote the healthy development of China’s oil industry.
