医疗救助制度是社会救助体系的重要组成部分,是多层次医疗保障体系中的最后一道保护屏障。2005年我国建立了覆盖城乡的医疗救助制度,但是该制度在实施过程中也遭遇了不少困境。本文从个体道德权利的理想性与现实性的困境、医院平衡义与利的困惑、药企药品专利权与生命权的冲突、政府兼顾实质正义与程序正义的两难等四个方面论述了该制度实施过程中所存在的问题,以期引起各方关注,促进该制度的改进、完善和全面实施。
The medical aid system is an important part of the social assistance system and the last protection barrier in the multi-level medical security system. In 2005, China established a medical aid system covering both urban and rural areas, but the system also encountered many difficulties in its implementation. This article discusses the system from four aspects: the ideal and the reality of the individual moral right, the hospital confusion of balance and interest, the conflict between the pharmaceutical enterprises’ patent right and the right to life, and the government’s dilemma of substantive justice and procedural justice The implementation of the problems in the process, with a view to arousing the attention of all parties to promote the improvement, improvement and full implementation of the system.
