环境影响评价是环境法的一项基本法律制度,对社会公众的生活质量和经济建设的环境影响有着重要的控制和监管的作用。环境问题必然会涉及公利益,所以在进行环境影响评价时,一定要有公众的参与,保障公众的环境权益。我国法律虽然明确规定了环境影响评价中公众的参与,在实践中也取得了一定成效,但是我国环境影响评价中的公众参与制度还存在一定的缺陷,应该采取相应的措施解决。
Environmental impact assessment is a basic legal system of environmental law that plays an important role in controlling and monitoring the quality of life of the general public and the environmental impact of economic construction. Environmental issues are bound to involve public interests. Therefore, when carrying out environmental impact assessments, there must be public participation to protect the public’s environmental rights and interests. Although China’s law clearly stipulates the participation of the public in environmental impact assessment, it has also achieved some benefits in practice. However, there are still some defects in the public participation system in China’s environmental impact assessment, and corresponding measures should be taken to solve it.
