●健全的国家医疗责任保险制度●严格的医生上岗制度●建立对医疗机构的评估制度●设立专门的法庭审理医疗诉讼医患矛盾一直是令社会纠结的问题,不时发生矛盾升级事件。然而,医患关系并非天生的对立矛盾体。在国外,医务人员是非常受尊重的,医患之间是一种融洽的朋友式关系,医务人员把疾病的发展、转归、预后告诉患者,患者也能理解医学的局限性。如此和谐的医患关系得益于科学、严格的医疗制度。纾解之策就是构建一个刚性的制度性渠道,让利益诉求与表达找到一个出口。如何建立完善科学的医疗管理制度呢?依笔者之见,可从保险、上岗、评估、司法四个层面来规范:健全的国家医疗责任保险制度。如果该案例在美国发生,负责解决纠纷的不是政府,而是由第三

The solution to this problem is to construct a rigid institutional channel that allows the export of interest claims and expression. How to establish and improve a scientific medical management system? According to the author’s opinion, it can be regulated from the four levels of insurance, induction, evaluation and justice: a sound national medical liability insurance system. If the case occurred in the United States, it was not the government that was responsible for resolving the dispute, but the third one.
