我国的物权变动规则应当在承认物权行为客观性的理论基础上区分动产和不动产,并规定相应的变动规则,不动产物权的变动由不动产登记的公示和公信力来确定,动产是以交付的公示来确定,并以善意取得制度进行补充和完善,但《物权法》把善意取得制度扩展到不动产物权变动中.我认为把动产善意取得和不动产登记公信力原理强行合并在立法上是一个没有充分考虑的问题,应在今后的立法中进一步完善。
