《劳动合同法》的制定和实施,其目的旨在改善劳动者的福利状况,这一目的的实现必然有赖于对劳动合同法立法目的以及劳动博弈机制的选择等基本问题的澄清。因此发挥劳动合同法应有的作用,改善劳动力市场的博弈状况是立法完善的重要指标。
The purpose of establishing and implementing the “Labor Contract Law” is to improve the welfare status of the workers. The realization of this purpose necessarily depends on the clarification of basic issues such as the legislative purpose of labor contract law and the choice of the labor game mechanism. Therefore, to play the due role of the labor contract law and to improve the game situation in the labor market are important indicators for the improvement of legislation.
