美国密西西比州法律和政策体系从联邦和州两个层面来保障流域生态环境的用水权,确立了生态环境用水的法律地位,并强调水使用的有益性和合理性。我国应借鉴密西西比州在法律中明确保障有益而合理的用水,确立生态环境用水的优先地位;中央与地方合作管理生态环境用水,将流域管理与区域管理的沟通合作机制进一步规范化、具体化。
The Mississippi law and policy system protects the water rights of the ecological environment of the basin from the federal and state levels, establishes the legal status of water for ecological use, and emphasizes the beneficial and rational use of water. China should draw lessons from the state of Mississippi in the law to clearly guarantee the beneficial and reasonable use of water and establish the priority of water for ecological environment. The central government and local governments jointly manage the water for ecological environment and further normalize and substantiate the communication and cooperation mechanism between watershed management and regional management.
