法律的边际情形是法律模糊性的普遍表现,因此而产生的边际案件始终是法律实践的难题。本文通过解读恩迪科特法律中的模糊性理论,从法律语言层面探讨边际情形的成因及在法律文本中的表现,总结回顾德沃金解释理论和哈特自由裁量观主张并以此作为裁决边际案件的方法。本文重点结合加拿大地方圆桌审判制度讨论了边际案件及其裁决对法治的影响,最后指出对边际情形的研究意义在于为法律提供更多的信息和方法以期解决法律和法律体系的本质与外延问题。
The marginal situation of law is a common manifestation of legal ambiguity, so the resulting marginal cases are always a difficult problem in legal practice. This article explores the causes of marginal situations and their performance in legal texts from the perspective of legal language by interpreting the ambiguity theory in Endicott’s law and concludes with a review of Dworkin’s explanation theory and Hart’s discretionary opinion Method of the marginal case. This article focuses on Canada’s local roundtable trial system to discuss the impact of marginal cases and its ruling on the rule of law. Finally, it is pointed out that the research significance of the marginal case lies in providing more information and methods to the law so as to solve the essence and denotation problem of the legal and legal system.
