高等学校学生管理法治化是指高校在学生管理服务中,为落实立德树人的根本任务,促进学生德智体美全面发展,保障学生权益,规范学校管理,依据宪法、法律法规,制定科学完备的规章制度,以调整学生管理各主体之间的权利义务关系,推进依法治校的过程。在高等学校学生管理中,高等学校作为公务法人,其与学生之间既存在着隶属型法律关系,又存在着平权型法律关系。随着社会发展,权利意识的觉醒,高等学校的权力与学生权利之间的冲突日益凸显,而权力与权利的平衡则是实现高校和谐管理的关键。“良法”与“善治”是实现高校学生管理法治化的重要途径。
