经济法要在新的时期有所发展,必须借助有一套完整的理论。虽然经济学与法学有着天然的契合性,经济学的原理很容易被理翻译成法学理论,但法学理论却不一定都能翻译成经济学原理。博弈论恰可以将经济法之人的理论翻译成经济学原理,并对其重新阐明和梳理。并在重新阐述经济法的重任之际,本文尝试理清经济法与民法的界限和适用方式的不同,最终提出对中国经济法的发展建议。
Economic law to be developed in the new period, we must rely on a complete set of theories. Although economics and jurisprudence have a natural fit, the principles of economics can easily be translated into jurisprudence theory, but not necessarily the theory of law can be translated into economic principles. Game theory just can translate the theory of economic law into the principle of economics and reinterpret it and sort it out. At the same time, when explaining the important task of economic law again, this paper attempts to clarify the difference between the limits of economic law and civil law and the ways of application. Finally, it puts forward some suggestions on the development of Chinese economic law.
