这早已是一则噩梦般的新闻:供职于广州某公司的年仅27岁的湖北籍青年孙志刚逛街时因未携带暂住证被公安机关错误收容,以致命丧收容站。备受社会关注的“孙志刚收容期间被伤害致死案”或许是2003年度最受国人瞩目的一个平民之死。在我看来,“孙志刚之死”的意义不在于息事宁人式地将凶手绳之以法以平民愤,而在于“孙志刚之死”产生的一系列拷问制度的震荡性效应,在于以一个年轻生命的无辜消亡为代价,将有悖宪政理念
