商主体是商法的核心内容,也是商法区别于民法的标志之一。商主体是一种特殊的法律人格体,它既关系到商法的调整范围和法律的适用,又关系到商主体的专门保护和商法的价值取向,其重要地位不言而喻。本文指出在商法学习过程中,对商主体概念的准确把握对培养商法思维至关重要。
Business entity is the core content of the commercial law, but also one of the hallmarks of the commercial law is different from the civil law. The main body of the business is a special body of legal personality, which not only relates to the scope of the adjustment of the commercial law and the application of the law, but also relates to the specialized protection of the business body and the value orientation of the commercial law. Its important status is self-evident. This article points out that in the process of commercial law study, the accurate grasp of the concept of business entity is crucial to foster the thinking of business law.
