民事法律关系是民事关系经过民法调整而上升为被法律所保护的一种法律关系。作为民法的核心和灵魂,它不仅体现了民法的精神和价值,而且也蕴含了民法的逻辑和方法。“好意关系”则是一种人与人之间互为帮助、增进情谊的表现,在我们日常生活中也颇为常见。它和民事法律关系在很多方面都具有相同之处,但同时也有很大的区别。因此,正确区分二者的界定范围有利于当事人对行为性质的把握,同时对我们指导实践也具有重要的理论价值。
