未成年人分流基于“宜教不宜罚”等理念,以便捷的非正式程序来替代繁琐的正式程序,解决情节轻微的未成年人犯罪与偏差问题,降低少年司法体系之正式干预,从而减少或避免问题少年标签化、促其改造自新及复归社会。本文分析总结了未成年人分流概念、特征、作用及历史沿革;未成年人分流类型;未成年人分流适用对象、条件及依据等内容。在此基础上,客观评析目前我国未成年人分流立法及司法实践中存在的问题并提出相应的完善建议。

This article analyzes and summarizes the concept, characteristics, functions and historical evolution of juvenile diversion; the type of juvenile diversion; the applicable subject, conditions and basis of juvenile diversion. On this basis, we objectively appraise the current problems of minors diversion legislation and judicial practice in our country and put forward some corresponding suggestions.
