村民自治制度是我国宪法规定的最重要的民主制度之一。经过多年的实践和探索,安徽农村基层民主建设取得了巨大进步。但是,在村民自治的发展过程中,仍面临着民主发展不平衡、村民自治蜕变为村干部自治等问题。政府为了解决这些问题,推行了一系列措施,包括村干部工资制、村财镇管等。文章对这些做法进行了法理分析,提出应当通过制度化的方式来界定乡村各权力主体间的权责关系、培育乡村社会内生力量等建议,期望以此推动农村基层民主的发展。
Villagers’ autonomy system is one of the most important democratic systems stipulated in our constitution. After many years of practice and exploration, great progress has been made in the construction of grassroots democracy in rural Anhui. However, in the course of the development of villagers’ autonomy, they still face the problems of unbalanced development of democracy and the transformation of villager autonomy into village autonomy. In order to solve these problems, the government has implemented a series of measures, including the salary system for village cadres and the management of village funds. The article conducts a jurisprudential analysis of these practices and puts forward some suggestions on how to define the relationship between power and responsibility in rural areas and how to cultivate the endogenous strength of rural society. It is hoped that this will promote the development of rural grass-roots democracy.
