云南省劳动和社会保障厅: 你厅《关于职工被人民检察院作出不予起诉决定用人单位解除劳动合同适用依据问题的请示》(滇劳社厅办[2003]35号)收悉。经商最高人民检察院、全国人大常委会法制工作委员会,现答复如下: 人民检察院根据《中华人民共和国刑事诉讼法》第一百四十二条第二款规定作出不起诉决定的,不属于《劳动法》第二十五条第(四)项规定的被依法追究刷事责任的情形。因此,对人民检察院根据《中华人民共和国刑事诉讼法》第一百四十二条第二款规定作出不起诉决定的职工,用人单位不能依据《劳动法》第二十五条第(四)项规定解除其劳动合同。但其行为符合《劳动法》第二十五条其他情形的,用人单位可以解除劳动合同。
