我国《物权法》规定的不动产登记制度基本采用德国的登记生效主义,该立法选择是我国立法尊重历史和现实的必然结果。究其原因,一方面古代中国的土地买卖登记制度与德国的登记生效主义的立法选择相似,另一方面,古代中国土地管理奉行的国家本位与德国登记制度代表的社会本位相类似,深受德国民法典影响的清末修律人员选择了德国登记生效主义。回首百年,《物权法》坚持了这一立法选择,这是对百年法制现代化历史的尊重。
The registration system of real property stipulated in the Property Law of our country basically adopts the registration validation in Germany. This legislative choice is the inevitable result of our country’s legislation respecting history and reality. On the one hand, the registration system of land sale in ancient China is similar to the legislative choice of registration validation in Germany. On the other hand, the national standard of land administration in ancient China is similar to the social standard represented by the German registration system, In the late Qing Dynasty, legal practitioners affected the registration of validations in Germany. Looking back a hundred years, the “Property Law” upholds this legislative choice, which is a century of respect for the history of the modernization of the legal system.
