法官不作为有拖延办案、发现罪行不移送、不报告、不遵守程序等不同的表现形式。其原因主要是司法腐败,司法权不独立、司法行政化,以及民众的法律意识和法官的专业素质缺乏。要改革目前的法院行政管理模式,法院经费由中央财政统一管理;法官的不作为给当事人造成严重损失时,由法院、法官协会先予赔付当事人,进而再追究法官的相应责任;要加强民众的法律意识,提高法官素质。
Judges did not act as delaying cases and found different manifestations of crimes such as non-delivery, non-reporting, non-compliance. The main reasons are the corruption of the judiciary, the independence of the judiciary, the administration of justice, the legal consciousness of the public and the lack of the professional quality of judges.
