TPP协议中版权条款的规定在一定程度上超越了TRi PS标准,其中对于作品复制权和保护期的规定更是如此。TPP协议使得网络环境中被搁置一段时间的“临时复制”又重回争议的“风口浪尖”。对于“临时复制”问题,美国和我国有不同的出发点,那么我国对待临时复制应当是“拒之门外”还是“引狼入室”?过度延长作品的保护期会剥夺创作者运用文化遗产进行再创作的能力。著作权人与公共利益的平衡,应当通过保障公众有适当的机会接近和利用作品实现。网络环境中作品传播成本的降低和增殖速度的加快使得应适当“限制”作者的专有权,形成利益平衡的格局。
