自媒体时代下,现代科技赋予每个人在事实上更多的表达自由。“微博上民间预报地震违法”作为自媒体言论自由的典型争议之一,可以此为例,引入并浅谈时下自媒体的定义以及特征,并从宪法基本权利的角度,分析得出自媒体上的表达自由当属狭义上的言论自由,而非新闻自由、学问自由等其他自由。以“预报地震”为线索,借鉴外国宪法学理论与案例,讨论“事实陈述”在宪法上得到的保护与受到的限制。自媒体上的表达在新时代里有重要的价值,应当给予足够的重视,赋予其更多的自由。
Since the media age, modern science and technology have empowered everyone in fact more freedom of expression. As an example of the typical controversy over freedom of speech and expression in the media, this article takes as an example the introduction and discussion of the definitions and characteristics of the media nowadays and from the perspective of the fundamental rights of the Constitution Freedom of expression in the media is freedom of expression in the narrow sense, not freedom of the press and freedom of learning. With “Predicting the Earthquake” as the clue, we can draw lessons from the theory and case of foreign constitutional law to discuss the constitutional protection and restriction of “factual statement”. Since the media expression has an important value in the new era, we should give it enough attention and give it more freedom.
