本文通过具体案例探讨当代互联网通讯条件下,艺术创作与侵犯他人隐私之间的界限。当今“脸书”、自拍、NSA数据采集等手段,大大拓展了获取个人信息的途径,在这样一个我们认为“隐私”已死的时代,合法关注他人或地域,与拍摄照片用于公共场所传播和展示之间的区别何在?这个问题是否仍然重要?艺术家认为,确定何处、何时需要充分的透明度,何处、何时需要隐私,这两个问题会改变我们的世界。实际上,艺术家也已获得了不经当事人预先许可,而行使艺术表现的自由权利。
This article explores the boundaries between artistic creation and infringing the privacy of others under the conditions of contemporary Internet communications through concrete cases.
