中国传统法律道德性以仁为核心,以天理,人情,法理为维度,反映了古代法律的立法之本.没有落后事物的消逝,就没有先进事物的引进与诞生.正是站在传统法律现代化的高度上,我们得以发现中国传统法律中存在着较为朴素的道德性,是法律本土的重要资源开发点之一。
The morality of Chinese traditional law is centered on benevolence, and based on the principle of human beings, human nature and law, it reflects the principle of legislation of ancient law. Without the disappearance of backward things, there is no introduction and birth of advanced things. On the height, we can find that there is a more simple morality in Chinese traditional law, which is one of the important resources development spots in the law.
