在高度信息化的21世纪,计算机已经相当的普遍,无论是计算机硬件技术还是软件技术都得到了长足的进步。其中计算机软件更可谓是以几何般的速度发展。但是,由于其传播方式简单,在发展的过程中,复制侵权现象从未停止,且有愈演愈烈的趋势。关于软件的立法和司法方面的欠缺是造成这种情况的原因之一,从计算机软件的发展初期到目前为止,对于计算机软件的知识产权保护主要采取的是版权保护模式,因为软件和版权法所保护的客体有所不同,是以版权法的保护方式已经无法对计算机软件形成有效且周全的保护。而专利法的保护方法由于其保护客体与软件的高度一致性,因此可以对软件进行更为完善的保护,本文正是基于此,探讨计算机软件使用专利保护模式的可行性问题,并提出关于专利保护模式的意见和建议。
