预告登记是一项重要的不动产登记制度,对它的研究直接影响到我国不动产交易的发展前景。在充分阐述我国预告登记的性质和特征的基础之上,进一步分析了预告登记在理论方面和现实生活中的价值,特别指出了它对于保护不动产交易中买受人将来实现不动产物权的意义。对预告登记制度的各方面客观调查之后,剖析出预告登记在立法、司法、程序操作等方面存在的不足,并且根据该制度应解决的主要突出问题,从立法和登记程序两个层次全面探讨了改进该制度的具体对策。
Registration of advance notice is an important real estate registration system, and its research directly affects the development prospect of real estate transaction in our country. On the basis of fully expounding the nature and characteristics of China’s advance notice registration, this article further analyzes the value of advance notice registration in both theory and real life, and especially points out its significance to the realist real right of the buyer in the real estate transaction. After an objective investigation of all aspects of the advance notice registration system, the paper analyzes the shortcomings of the advance notice registration in terms of legislation, judicature, procedural operation and so on. According to the major outstanding issues that should be solved under the system, it discusses in full from the two levels of legislation and registration procedures Specific measures to improve the system.
