为治理商业贿赂行为,国务院各部委制定了大量的部门规范性文件以指导行政执法。首先肯定其在我国商业贿赂治理行政法律体系中的地位,并主要以国家工商总局制发的部门规范性文件为例,分析其在正确适用法律、具体指导行政执法中的重要作用。并围绕反不正当竞争法的修改,提出相应立法建议。
In order to control commercial bribery, various ministries under the State Council have formulated a large number of departmental normative documents to guide administrative law enforcement. First of all, it affirms its position in the administrative legal system of commercial bribery in our country, and mainly takes the departmental normative documents issued by the State Administration for Industry and Commerce as an example to analyze its important role in correctly applying the law and specifically guiding the administrative law enforcement. And around the anti-unfair competition law changes, put forward the corresponding legislative proposals.
