随着知识产权保护制度从传统的国内智力成果保护领域走向知识产权贸易的国际市场,全球化经济与加强知识产权犯罪预防已被世界关注。而我国的知识产权现状令人堪忧:知识产权犯罪情形严重,经济发达地区的犯罪率高,预防合作与服务不畅。导致以上犯罪问题存在的原因包括立法滞后,利益驱动,重行轻刑,惩治适度等。为此必须进行全球化时代背景下的知识产权犯罪预防研究,通过提高公民知识产权意识,健全知识产权刑法体系,符合本国实际等途径来实现。
With the system of intellectual property protection moving from the traditional field of intellectual property protection to the international market for intellectual property trade, the global economy and the prevention of crime of strengthening intellectual property have drawn worldwide attention. The current situation of intellectual property in our country is worrying: serious crimes in intellectual property, high crime rates in economically developed areas and poor cooperation in prevention and service. The causes of the above criminal problems include the lag of legislation, interest-driven punishment of minor crimes and the proper punishment. Therefore, it is necessary to carry out research on the crime prevention of intellectual property crime in the era of globalization, by raising citizens’ awareness of intellectual property rights, perfecting the criminal law system of intellectual property rights, and in line with the actual conditions of our country.
