临沧南美乡拉祜族的物权习惯法是其民族传统习惯法的重要组成部分,在其民族社会生活中发挥着约束、规范和指引作用。土地使用权是该地区最主要和最重要的物权类型,尽管人们的土地权利意识和用地习惯与现行法有一定的冲突,但在现实生活中却为人们所遵循,发挥着实际的作用。而这种土地权利意识和土地利用习惯,影响着土地权利功能的发挥。通过总结其物权习惯法的基本特点,分析其对民族社会中土地权利意识及土地权利利用的影响,可以为调适其物权习惯法与国家现行法之间的关系提供借鉴。
The customary law of real rights of the Lahu people in South America and the United States in Lincang is an important part of their national traditional customary law and plays the role of constraint, normative and guiding role in their ethnic and social life. Land use rights are the most important and important type of property rights in the region. Although people’s land rights awareness and land use practices have some conflicts with current laws, they are actually followed in real life and play a practical role. However, this sense of land rights and land use habits affect the function of land rights. By summarizing the basic features of customary law of property rights and analyzing its influence on the awareness of land rights and land use rights in ethnic society, it can provide reference for adjusting the customary law of property rights and the current state law.
