当前,精神障碍患者的监护乱象频现,涉及精神障碍患者案件的审理存在诸多难题。我国应当借鉴韩国、日本等国家监护制度的立法经验,结合我国国情,构建新型精神障碍患者监护制度。其具体内容包括被监护人和监护人的确认机制、监护事项和监护人的变更机制、监护的监督机制及监护的保障机制。
At present, the guardianship disorder of patients with mental disorders is frequent. There are many problems concerning the trial of patients with mental disorders. Our country should learn from the legislative experiences of the guardianship systems in South Korea, Japan and other countries and construct the guardianship system for new-type mental disorders in light of China’s national conditions. The specific contents include the confirmation mechanism of the guardians and guardians, the change mechanism of guardianship matters and guardians, the supervision mechanism of guardianship and the safeguard mechanism of guardianship.
