谋财杀人案系指由盗窃、抢劫而导致杀人的案件,它在全部杀人案中占有很大比例。就武汉市来说,1991-1995的5年间共发各类杀人案730起,其中谋财杀人案204起,占28%。在上述5年间,谋财杀人案占全部杀人案的比例分别为23.2%、24.6%、27.6%、29.8%、33.3%,呈逐年上升趋势。谋财杀人案较之其他杀人案的犯罪因果关系模糊,犯罪的随机性、跨越性大,所以比其他杀人案更难以侦破。武汉市上述5年间未破获的各类杀人案有206起,其中谋财杀人案119起,占57.8%。谋财杀人案发案率高,破案率低,使得相当一部分犯罪分子逍遥法外,有的甚至有恃无恐继续作案;而冤死的受害人得不到昭雪,人民群众义愤难平,弘扬法制在这里成了一句空话。
