我国于2008年7月1日起正式实施由建设部组织制定的基于《物权法》等法律的《房屋登记办法》。根据《物权法》的立法精神,调整和完善了登记规则,相对于1997年建设部57号令(2001年修改版)的《城市房屋权属登记管理办法》有了众多的改变,本文分析了这种变化,并就此提出了在房屋登记工作中应应注意和加强的工作内容,对深入理解新的《房屋登记办法》以及做好房屋登记工作有所借鉴。
On July 1, 2008, China formally implemented the “Housing Registration Measures” based on the “Property Law” and other laws and regulations formulated by the Ministry of Construction. According to the legislative spirit of the Real Right Law, the registration rules have been adjusted and improved. Compared with the “Measures for the Administration of Urban Housing Ownership Registration” issued by Decree No. 57 of the Ministry of Construction in 1997 (revised version of 2001), many changes have been made in this article In the meantime, this paper puts forward the content of the work that should be noticed and strengthened in the housing registration work, and draws lessons from the deep understanding of the new “Housing Registration Measures” and the housing registration work.
