问:有一妇女,土地改革时还未结婚,在她娘家登记人口分下土地,但结婚时没有带到男方家里。现在两人感情不合提出离婚,经政府调解无效。关于财产问题,女方除带婚前自己的财产外,坚决要带一份土地。男方以土地改革时女方不在他家计人口为理由不允许带土地,该怎样处理?答:土地改革时女方在娘家已分得一份土地归她所有,结婚时未将这份土地带到男家,则在离婚时,要求带走男方一份土地,是不应该的,不能允许的。但其他财产仍应依婚姻法第二十三条的规定办理。
