近年来,我国的腐败犯罪出现了许多新的情况,对相关的法律适用提出了许多新的要求,其中突出的问题之一就是国家工作人员的配偶、子女、近亲属、关系密切的人,为请托人谋取不正当利益,索取或收受请托人财物的案件不断出现。另一个突出的问题是,一些离职后的国家工作人员依然会有利用在职时形成的社会关系、社会资源去索取、收受请托人财物的隐性权势的影响力和寻租空间。
