新刑诉法从多方面完善了我国的辩护制度,但实践中还仅仅停留在保障被追诉人享有辩护权的层面,更高层次的有效辩护仍未实现。本文从有效辩护在我国的发展现状入手,结合刑诉法修改为我国有效辩护提供的环境土壤,试图探索有效辩护在我国刑事法律中的确立,为被追诉人提供高质量的法律服务。
The new Criminal Procedure Law has perfected the system of our country’s defense in many aspects. However, in practice, it only stays at the level of safeguarding the right of defense of the people being prosecuted. A higher level of effective defense has not yet been realized. This article begins with the effective defense in the development of our country, combined with the modification of the Criminal Procedure Law to provide the environment for the effective defense of our country, tries to explore the establishment of effective defense in criminal law of our country and provides high quality legal services for the prosecutors.
