从近代法治到现代法治的转型制约依法行政原则的演变，学术界将依法行政原则从依法治国的基础性要求人为地上升到依法治国的核心、关键地位，既有悼于法治的现代精神，又曲解依法治国的科学内涵。建立社会主义法治政府才是实现依法治国，建设社会主义法治国家的关键。
The transition from modern rule of law to modern rule of law restricts the evolution of the principle of administrative law according to law.
