当代中国语境下的法律信仰乃是主体对本身内在具备公平、正义、自由、秩序等本质的法律开放式自治性系统,经理性认知和情感体验后的敬畏、接受、认可、遵从和坚守的态度,对于个体而言,法律信仰意味着对权利的守护,自由的追求、正义的希望和安全秩序的内在需求和神圣认可;对于群体而言,法律信仰意味着对权力的制约、秩序的安全、效率的提高、自由的保护。本文指出,对法律信仰的内涵考察,需要对当前学界有关法律信仰概念进行批判综述,进而探析法律信仰在当代中国语境下的内涵。
The legal belief in the contemporary Chinese context is the system of open, autonomous and autonomous system of law which is inherent to itself with the principles of fairness, justice, freedom and order. The awe, acceptance, approval, compliance and perseverance of the cognitive and emotional experience For individuals, legal belief implies the inherent need and sacred endorsement of the rights to guard, the pursuit of freedom, the hope of justice and the security order; for the community, legal belief implies the restriction of power, order Security, efficiency, freedom of protection. This paper points out that the investigation of the connotation of legal belief requires a critical review of the current concept of legal belief in academic circles and then analyzes the connotation of legal belief in contemporary Chinese context.
