我国认为《罗马规约》第17条第2款关于国家“不愿意”管辖的判断标准过于主观,国际刑事法院会因此成为凌驾于国内法院之上的“上诉法院”。分析我国立场的关键在于对《规约》中“国际法承认的正当程序原则”的解释与适用。如果国际刑事法院在实践中将国内诉讼对当事人国际人权公约所载权利尤其是公正审判权的保障情况纳入其审查范围,就不但会混淆其与国际人权条约机构的不同职能,而且会加深我国对其成为“上诉法院”的担忧。
My country believes that the standard of judgment in article 17, paragraph 2, of the Rome Statute on the jurisdiction of the country “is not subjective” is too subjective and that the International Criminal Court will therefore become the “Court of Appeal” over domestic courts. The key to analyzing our position lies in the interpretation and application of the “Principles of Due Process Recognition in International Law” in the Statute. If, in practice, the ICC included domestic proceedings in the scope of its review of the rights guaranteed by the parties to international human rights conventions, and in particular the right to a fair trial, it would not only confuse its different functions with the international human rights treaty bodies but would also deepen our country’s It becomes “Court of Appeal” concerns.
