上海社保腐败窝案东窗事发,引起了全社会的极大关注。这充分暴露了社保资金管理制度设计存在着先天不足,加之缺乏对官员权力的刚性约束,最终导致社保资金成为饕餮者的盛宴。实事求是地说,社保资金的管理制度并没缺位,劳动部和财政部多年前就联合发文强调,禁止将社保基金拿到市场上运作,已经投出去的钱要收回。然而,这种规定并非完美无缺、无懈可击。当下,有的部门强调随着社保资金总额的增多,必须实现资金保值增值。其动机不可谓不好,但现有制度上并没有对如何保值增值进行明确规定,给官员权力寻租制造了空间。于是,手握资金管理大权的腐败官员就会以“保值增值”
