由于每个国家都有自己的独立法制,因此有时这种情况不利于不同国家的人之间建立贸易合同关系,并使对外贸易滞后于经济发展的进步。在现代世界中,国际贸易法可以解决很多与世界经济全球化和世界市场发展有关的问题。对国际贸易法的理解有助于简化国际商事合同的订立过程、合理地规定合同条件并快捷地解决合同当事人之间发生的纠纷。所以,打算从事世界贸易领域的工作,为客户提供国际商事合同的咨询服务,并参与国际仲裁、诉讼的法律工作者必须了解国际贸易法最新发展的特点。本篇文章的目的在于研究与现代国家贸易法有关的最新观点并考虑它们的现实作用,同时试图解决一些在这方面发生的科学与实务问题。
Since each country has its own independent legal system, sometimes this situation is not conducive to the establishment of trade contractual relations among people of different countries and lags behind foreign trade in the progress of economic development. In the modern world, the law of international trade can solve many problems related to the globalization of the world economy and the development of world markets. The understanding of the law of international trade helps to simplify the process of establishing international commercial contracts, rationally stipulate contract conditions and quickly resolve disputes between the parties to the contract. Therefore, law practitioners who intend to engage in the field of world trade, provide advisory services on international commercial contracts to clients and participate in international arbitration and litigation must understand the latest development of the law of international trade. The purpose of this essay is to study the latest ideas related to modern national trade law and to consider their practical role, while trying to address some of the scientific and practical issues that have arisen in this regard.
