社区矫正制度在中国已初步确立,但在司法实践中,广泛存在着将不同类型的社区服刑人员按照统一不变的模式塑造的统一管理方式。基于行刑个别化原则的理论及为更高质量地推进社区矫正工作考量,笔者建议更深入地研究社区矫正对象的分类及其不同的矫治对策,并提出境外矫正对象的管理建议。本文结合昆山社区矫正工作实际,从管理体制建设、监督管理、指导服务等方面,就如何加强境外社区矫正对象管理工作进行了探讨。
The community correction system has been initially established in China. However, in the judicial practice, there is a wide range of unified management methods in which different types of community prisoners are modeled on a uniform basis. Based on the theory of individualization of executions and the consideration of community correction work for higher quality, the author suggests that the classification of community correction objects and their different corrective measures should be studied in more depth and suggestions on the management of overseas correction objects should be proposed. Based on the actual practice of community correction in Kunshan, this article discusses how to strengthen the management of overseas community corrections from the aspects of management system construction, supervision and management, and guidance service.
