国有化问题,是国际投资法的一个非常重要的问题。它涉及到国有化的合法性、根据、补偿标准、补偿计算方法等许多方面,其中还有许多理论问题尚未解决。虽然几乎所有的双边投资条约和多边投资条约都对这一问题作了规定,但是当国有化行为产生纠纷时,投资者母国也往往被牵扯进来,使原本复杂的问题更加难以解决。因此,如何解决这一问题,使其更符合经济全球化发展的趋势,依然有必要进行研究。
Nationalization is a very important issue of international investment law. It involves many aspects such as the legitimacy of nationalization, the basis, the compensation standard, the method of compensation and so on. Many of the theoretical issues remain unresolved. Although almost all BITs and multilateral investment treaties provide for this issue, when the dispute of nationalization arises, the home countries of investors are often involved, making the originally complex issues more difficult to solve. Therefore, it is still necessary to study how to solve this problem and make it more in line with the trend of economic globalization.
