■案例工程承包商刘某,与某小学签订协议建教学大楼。工程完成后,建筑工地(校园内)遗留下一个四米见方的坑未及时填平。某日暴雨后,坑中积满了雨水。第二天一早,几个前来上学的小学生围在坑边玩耍,学生李某(11岁)不慎将同学高某(10岁)推入坑中。由于坑深达2米,高某立即沉没水中。几个学生惊惶失措地跑到学校办公室向老师报告,等老师赶到水坑处救人时,高某早已溺水身亡。高某家长起诉学校,要求学校承担孩子死亡的损害赔偿。
