未成年人监护制度关系到一个国家未成年人的健康成长,我国的未成年人监护制度不够完善,在国家公权干预监护领域存在空缺。本文在借鉴日本、美国、德国的公权力介入未成年人监护制度经验的基础上,认为国家公权应干预未成年人监护,并提出了公权干预的建议,保障未成年人的权益。
The system of guardianship of minors is related to the healthy growth of minors in a country. The system of guardianship of minors in our country is not perfect enough and there is a vacancy in the field of state public security intervention. On the basis of drawing lessons from the experiences of the public authority in Japan, the United States and Germany involved in the supervision of minors, this paper argues that the state public right should intervene the guardianship of minors and put forward the suggestion of public intervention to protect the rights and interests of minors.
