在经济改革与立法过程中,地方或部门作为理性的经济人常常会通过各种途径来表达自己的意愿和争取自己的最大利益,对这一现象我们应理性看待。从公共选择与制度变迁的视角进行分析,立法并不是某种抽象利益的表述,而是不同利益主体利益博弈的结果。目前,就经济立法而言,需要增强的是人们对市场经济条件下利益分歧与冲突的理解,并寻求一种新的关于改进经济立法过程中的利益平衡的方式。
In the course of economic reform and legislation, local or departmental economic agents, as rational agents, often express their wishes and strive for their best interests through various channels. We should take a rational view of this phenomenon. From the perspective of public choice and institutional change, the legislation is not an expression of some abstract interests, but the result of the game of interests among different stakeholders. At present, in terms of economic legislation, what needs to be enhanced is that people understand the differences and conflicts of interests in the market economy and seek a new way to improve the balance of interests in the economic legislation.
