近年来,浦东区院受理的非法拘禁案件一直呈现不断上升的趋势,严重危害了公民的人身、财产权益和社会的正常稳定秩序。根据数据分析,可以发现因索取债务而发生的非法拘禁案件已成为此类案件的绝对多数。本文通过分析近年来索债型非法拘禁案件的数据,分析其特点及案发原因,并就降低犯罪提出防范对策,最后就该类案件的法律适用提出建议。
In recent years, the cases of illegal detention accepted by the Pudong District Court have been on a continuous upward trend, seriously endangering the citizens’ personal rights, property rights and interests and the normal and stable social order. According to the data analysis, it can be found that the number of cases of illegal detention resulting from the claim for debt has become the absolute majority of such cases. This article analyzes the characteristics of the debt-seeking illegal detention cases in recent years, analyzes the causes and causes of crimes, and puts forward countermeasures to reduce crime. Finally, the author puts forward suggestions on the legal application of such cases.
