现代型海盗犯罪成为当今世界的严重威胁,本文从研究《联合国海洋法公约》中海盗罪的概念及构成特征角度出发,对国际法应当扩大或缩小海盗罪构成要件内涵的各学术观点做出回应;结合今日热点问题——索马里海盗事件,重申各国打击海盗罪之义务,并分析我国派舰艇赴亚丁湾护航的合法性依据及其积极意义;基于我国迫切需要设立海盗罪以保护海洋运输安全。文中详述我国刑法应如何增设海盗罪,以期能提出建设性意见。
Modern pirate crime has become a serious threat to the world today. From the perspective of studying the conception and constitution features of piracy in the United Nations Convention on the Law of the Sea, this article responds to various academic views that international law should enlarge or reduce the connotation of the elements of piracy. Combining with the hotspot issue in the world today - the Somali piracy incident, we reaffirmed the obligation of all countries to combat piracy and analyzed the legitimacy basis and the positive significance of our escort of ships to the Gulf of Aden. Based on our urgent need to establish piracy crimes to protect maritime transport security. The paper details how to add piracy crime in our criminal law, with a view to putting forward constructive suggestions.
