古典自然法学派从一开始就存在着将自然法认定为一种规律的倾向。我国现代学者亦有将自然法作为规律进行解释的思潮。自然法的本质就是规律。商法是市场交易规律的反映,符合规律的客观性、必然性和可重复性。自然法精神贯穿于商法之中。交易自然法指导着商法制定法。自然法的普遍性思想为商法世界的统一提供了理论基础。
From the very beginning, the classical natural law school tended to recognize natural law as a law. Modern Chinese scholars also have the tendency to interpret natural law as a law. The essence of natural law is the law. The law of commerce is a reflection of the law of the market transaction, obeying the objectivity, necessity and repeatability of the law. The spirit of natural law runs through the commercial law. The natural law of trading guides the lawmaking of commercial law. The universality of natural law provides a theoretical basis for the unification of the commercial law world.
