入世以来,跨国公司知识产权滥用的行为已经给我国民族企业带来严重的冲击,使我国经济蒙受了重大损失。我国急需建立跨国公司知识产权滥用的法律制度。本文从分析对跨国公司知识产权溢用进行规制的必要性入手,对其滥用知识产权的表现进行了分析,提出了规制跨国公司知识产权滥用的立法建议。
Since the accession to the WTO, the abuse of intellectual property rights by multinational corporations has brought serious impact on our national enterprises and caused great losses to our economy. China urgently needs to establish a legal system for abuse of intellectual property by transnational corporations. Based on the analysis of the necessity of regulating the spillover of intellectual property in multinational corporations, this paper analyzes the performance of abuse of intellectual property, and puts forward some legislative proposals to regulate the abuse of intellectual property by transnational corporations.
