最高人民法院关于审理商品房卖卖合同纠纷案件适用法律若干问题的解释(法释[2003]7号,以下简称司法解释)已于2003年6月1日起施行。司法解释施行后,人民法院在审理商品房买卖合同纠纷案件中,严格按照相关法律以及司法解释的规定,作出了一些不利于房地产开发商的判决,笔者认为一名房地产专业律师,代理了大量的房地产纠纷案件。综合这些案件,笔者认为,虽然司法解释中严格了开发商的责任,客观上加大了开发商的风险,但开发商若充分理解司法解释的内容,对于自己在开发经营过程中所面临的风险有正确的认识,风险是可以避免的。
