我国未决羁押存在适用范围过广、羁押期限过长、超期羁押现象非常普遍且久禁不止等严重问题。引起这些问题的原因涉及诉讼体制、立法规定、办案人员、社会状况以及案件本身等多个方面。解决这些问题应当采取以下措施 :完善诉讼体制 ,严格限制羁押期限 ,建立羁押的程序性裁判机制 ,确立超期羁押的程序性制裁制度 ,切实贯彻无罪推定原则 ,等等。
The pending detention in our country is characterized by a wide range of applications, long duration of detention, prolonged detention and widespread serious problems. The causes of these problems involve litigation system, legislative provisions, investigators, social conditions and the case itself. To solve these problems, the following measures should be taken: perfecting the litigation system, strictly restricting the duration of detention, establishing a procedural judging mechanism for detention, establishing procedural sanctions regime for prolonged detention, and earnestly implementing the principle of presumption of innocence.
